KING CAESAR BEACH TRUST, LLC
BEACH INFORMATION
General Beach Information
The King Caesar Beach is privately owned by the King Caesar Beach Trust, LLC. (KCBT Trust), which operates as a non-profit Massachusetts limited liability company. The Beach extends for a distance of 220 feet (in a Northeasterly direction) from the concrete wall, next to the entrance pathway and runs along the waterside of 283 King Caesar Road, immediately to the right of the entrance pathway. This small Beach is essentially a wild and natural Beach with no lifeguards or other active supervision or management; and use of the Beach shall be at the sole risk of any authorized person using the Beach.
The Beach is not open to public use
The Beach is available for use only by certain property owners and their guests who have been granted easements ( contractual rights) for access to and use of the Beach for the purpose of swimming (i.e. “ walking and bathing”) and also (in certain cases) to “land boats”, all subject to the rules on Beach use as adopted from time to time by the KCBT Trust. The Beach is also available for use by persons who are current Members of the KCBT Trust for swimming and for general beach activities, subject to rules of the KCBT Trust on Beach use. Limitation of Liability
The KCBT Trust and each of its officers, directors, agents, advisors and third parties, who permit use of any portion of their adjacent real property to all authorized users of the King Caesar Beach,(collectively and individually referred to as “KCBT Trust”), shall have no responsibility or liability for any personal injury or property damage sustained on the King Caesar Beach. There are no lifeguards at the King Caesar Beach. Entry upon or use of the King Caesar Beach by any person shall be at his or her own risk and such entry or use shall constitute a release by such person of the KCBT Trust from any and all claims for personal injury or property damage sustained on the King Caesar Beach, and such release shall be binding upon such person, his personal representative, and all persons claiming through or under him or her. Entry upon and use of the King Caesar Beach by any person shall also constitute an acceptance of the applicability of the Beach Rules and Regulations, including in such Rules an acceptance of an Indemnification of the KCBT Trust (and others) in furtherance of the limitation on liability of the KCBT Trust arising from entry upon or use of the King Caesar Beach.
